Updated Transfer Policy Takes Effect on January 1, 2022

Senate Bill 783 was signed into law in March of 2021 and changes to Oklahoma’s school transfer laws went into effect on January 1, 2022.
Jenks Public Schools makes decisions about student transfers in accordance with District policy and state law. The JPS Board of Education determines transfer capacity in each grade level at each school site. This information is published to the District website by the first day of January, April, July, and October each year. (See capacity chart below.)
Transfers will only be considered for acceptance if there is availability in the grade level requested by the parent or guardian. If there are multiple open seats in the desired grade level across school sites, the District will determine the site in which the student is placed. New transfers are accepted on a first-come, first-serve basis and will be processed in a timely manner. If approved, parent(s)/guardian(s) will be required to provide transportation to and from school.

Current Transfer Students
If your child currently attends JPS on a transfer prior to January 1, 2022, he/she may continue to attend JPS annually without re-application if there are no attendance or discipline issues. You will be notified annually when your child’s transfer for the next school year has been approved.
Children of Current JPS Employees
Current transfers for students of classified and certified employees will continue into the 2022-23 school year without re-application as long as discipline and attendance requirements are met.
ALL employee children may transfer into the district above the posted capacity as well as siblings of students. Discipline and attendance requirements must be met. If the student is served in special education, there is a separate process.
Families Considering Moving
If a student has resided in the JPS district for three or more years and then moves out of the district, the student can remain at Jenks Public Schools if they meet attendance and discipline requirements. These students will need to complete a Transfer Application.
Request a Transfer to JPS
The Oklahoma State Department of Education requires the Student Transfer Application Form be completed by a parent or guardian.
Transfers for siblings will be considered separately. If the grade requested is over capacity, the student can be placed on a waiting list for the current school year. Transfer students must abide by eligibility requirements established by the Oklahoma Secondary Schools Activities Association (OSSAA) for OSSAA-sanctioned activities.
Parents or guardians who need access to technology to complete the transfer application form can visit the Jenks Public Schools Enrollment Center (951 W. Main St. Jenks, OK 74037 – first floor of the Community Service Center). The JPS Enrollment Center is open Monday-Thursday from 7:30 a.m.-4:00 p.m.

Student Transfers – Frequently Asked Questions
1. When does the transfer change take effect?
January 1, 2022.
2. Can my student transfer to a district where they do not reside?
Yes.
3. When can I request a transfer for my student?
A parent or guardian may complete a transfer application at any time during the current school year. Applications will be processed after January 1, April 1, July 1, and October 1. Applications for the 2022-23 school year will begin in Summer 2022.
4. How do I request a transfer for my student?
To request a transfer, simply complete the Student Transfer Application Form. Individuals without access to the internet may visit the JPS Enrollment Center to submit the application electronically.
5. Is there a limit to the number of times my student can transfer each year?
Yes. A student may transfer only twice per school year. This limit does not include re-enrolling in your district of residence. Additionally, students in foster care many complete any number of transfers in a given school year and are not subject to the two-transfer limit.
6. How long does a transfer last?
Transfers granted after January 1, 2022 are valid for the remainder of the 2021-22 school year. At the end of each school year, a school district may deny continued transfer of the student for discipline or attendance.
7. On what basis might JPS deny my transfer request?
Transfers may be denied for any of the following reasons:
a. The desired grade level at the school site has exceeded its enrollment capacity.
b. There are incidents of student discipline for reason(s) outlined in 70 O.S. § 24-101.3 and/or
c. The student has a history of absences, which is defined as ten or more unexcused absences in one semester 70 O.S. § 8-101.2 (B)(2).
8. How do I know if Jenks Public Schools has capacity for my student?
See chart above for current capacity.
9. Are there any students who receive special consideration when applying for a transfer?
Yes. Transfer applications are distinct for the following student groups:
a. Students of JPS Employees: A child of a JPS employee may transfer into the District regardless of capacity.
b. Military dependent students: A student who applies for a transfer and whose parent/guardian is an active member of the military or a member of the military reserve on active duty cannot be denied a transfer because of capacity limitations.
c. Students in foster care: Any student in foster care currently placed in the home of another student enrolled in a district may transfer to said district regardless of capacity. Additionally, students in foster care many complete any number of transfers in a given school year and are not subject to the two-transfer limit.
d. Students with disabilities: Prior to the approval of the transfer of a child on an individualized education program (IEP), a joint IEP conference must be conducted between the district of residence and Jenks Public Schools. JPS must establish the availability of the appropriate staff, and services prior to approving the transfer.
10. Can I appeal the denial of my student’s transfer request?
Yes. If JPS denies a transfer, the parent or legal guardian of the student has 10 days to appeal the denial to the JPS Board of Education. The Board must consider the appeal at its next regularly scheduled board meeting. JPS will provide the appeal form. If the Board of Education upholds the denial of the transfer, the parent or legal guardian may appeal the denial to the Oklahoma State Board of Education within 10 days of receiving notice of the JPS Board’s decision. The Oklahoma State Board of Education must consider the appeal at its next meeting and allow both the parent and receiving district to appear.
